In a major development in the Sushant Singh Rajput death case, the Supreme Court has given a ruling on Thursday which is important for cases under the NDRP Act. The decision that a statement recorded under section 67 cannot be used as a mark of offense under the Act.
Riya Chakraborty’s lawyer reacted to the judgment given by the Supreme Court and said it was a ‘landmark declaration’. He was quoted by the Times of India as saying, “The decision given by the Hon’ble Supreme Court in relation to Section 67 of the NDPS Act is a landmark declaration. A large number of people have been imprisoned and punished in the last 35 years on the basis of statements made forcibly using third degree, coercion and threats to violate their fundamental rights. “
Speaking about the SSR death case, he pointed out, “Even in the case of all the accused in the SSR drugs angle case, there is hardly any recovery and independent evidence to allege serious offenses. They are detained on the basis of reckless statements. In view of this decision presented by Justice Rohington Nariman and Naveen Sinha, a large number of accused will see the light of day. Similarly, Justice Nariman had given a decision under the PMLA in relation to Section 45, which illegally released him on bail for a large number of those detained. Satish Manashinde Furrer claimed that Riya Chakraborty’s case was ‘lost in the merits of the allegations based on this judgment’.
